1. GENERAL

  2. Personal Data collected by the Controller via the www.flc.com.pl website are processed in accordance with the General Data Protection Regulations 2016 (GDPR)
  3. Customers and users shall be referred to collectively as „Users”.

2. THE LEGAL GROUNDS FOR THE PROCESSING OF PERSONAL DATA

  1. The necessity to perform a contract to which User is a party or to which User is a representative, or to take action at User’s request, prior to the conclusion of the contract [art. 6(1)b GDPR].
  2. Fulfil the Controller’s legal obligations [art. 6(1)c GDPR].

3. THE PURPOSE OF THE PROCESSING OF PERSONAL DATA

  1. Taking pre-contractual activities, in particular the provision of an offer at the request of the data subject.
  2. Performance of activities related to the performance of a concluded contract.
  3. Marketing of own products or services, including personalised ones - only if User agrees to them
  4. Protection of the legitimate interests pursued by the Controller

4. CATEGORIES OF PROCESSED PERSONAL DATA

  1. The Controller collects and process personal data provided voluntarily by the User in a contact form. Collected personal data includes:
    • E-mail.
    • Name.
    • Phone number.
  2. During use of the website, additional data may be collected like: IP address of user's computer or Internet Service Provider address, domain name, browser type, browsing time, operating system type. Navigation data may be collected, including information about hyperlinks or other activities taken at website. The legal ground is protection of the legitimate interests pursued by the Controller [art. 6(1) GDPR] (optimisation of website usability and user experience)

5. STORAGE OF PERSONAL DATA

  1. Personal Data processed in order to perform the agreement and fulfil the Controller's legal obligation shall be stored for the duration of the agreement, and after its expiry for the period necessary secure or enforce claims, fulfil the Controller's legal obligation (e.g. resulting from tax and accounting regulations). If there are no special regulations, the period is six years.
  2. Personal Data collected with user’s expressed consent in order to perform the agreement and fulfil the Controller's legal obligation shall be stored until the user’s consent is revoked and after its expiry for the period necessary secure or enforce claims, fulfil the Controller's legal obligation.

6. RECIPIENTS OF PERSONAL DATA

  1. Personal Data may be shared with service providers to host the website and email services.
  2. Personal Data may be shared with authorities to fulfil the Controller’s legal obligations

7. TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY OR INTERNATIONAL ORGANISATIONS

  1. Personal Data are processed in EU countries only.

8. RIGHTS OF THE DATA SUBJECT

  1. Anyone whose personal data is processed by the Controller has the right of access to the content of the processed data and the right to correct or delete data, limit its processing, the right to transfer data, the right to object to data processing on the basis of the Controller’s legitimate interest or to the processing for the purpose of direct marketing, the right to withdraw consent at any time without affecting the lawfulness of the processing. The Controller shall stop processing personal data and delete it unless it is required by the law to process it further. Legal grounds:

    • Rectification of Personal Data [art. 16 GDPR].
    • Erasure of Personal Data (right to be forgotten) [art. 17 GDPR].
    • Restriction of processing of Personal Data [art. 18 GDPR].
    • Right to data portability [art. 20 GDPR].
    • Object to Personal Data processing [art. 21 GDPR].
    • Revoke consent [art. 7(3) GDPR].
  2. In order to exercise User’s rights please contact the Controller by sending an email to: info@flc.com.pl.
  3. Upon User’s request the Controller will process User’s request within 30 days of receiving User’s message and inform the User about Controller’s activities.
  4. User has right to lodge a complaint with a supervisory authority (Prezes Urzędu Ochrony Danych Osobowych)

9. INTELLECTUAL PROPERTY

  1. Images published in the website www.flc.com.pl are copyrighted and owned by the Controller. Using the images without written authorisation from the Controller is violation of Intellectual Property rights.
  2. User is fully responsible for legal use of the presented images.

10. FINAL PROVISIONS

  1. The Controller reserves the right to make changes to the Privacy Policy. The Controller will inform Users about changes by publishing updated policy in the website.
  2. The website contains hyperlinks to other websites. Such websites operate independently and may have their own privacy policies and regulations that we recommend to read.
